Centre for mediation at Croatian Chamber of trades and crafts
The Centre for Mediation at Croatian Chamber of Trades and Crafts was established under the Mediation Act (Official Gazette 163/03) and pursuant to the decision of the General Assembly of Croatian Chamber of Trades and Crafts of June 30, 2004. It provides mediation and peaceful dispute resolution services to Chamber members as well as natural and legal persons from the country and abroad.
These services belong to Chamber’s tasks determined by the Trades Act and Chamber’s Statutes, which are, among others, assisting tradesmen to run their businesses, shaping the economic system, building and improving all kinds of business relationships, stimulating innovation (also in the field of services), stimulating and developing good business practices and business ethics.
The dispute resolution services, which are faster, cheaper and often higher-quality alternatives to litigation process, aimed at settlement agreement of the parties, keep the whole procedure very confidential and protect the business relations of the parties, are provided by trained mediators from the Centre for Mediation’s list of mediators, freely chosen by the parties.
As opposed to the Court of Honour, mediation proceedings before the Centre for Mediation are completely voluntary from their beginning to the end and confidential in accordance with the agreement of the parties.
The activities of the Centre, its bodies, relations to the parties and mediators’ remunerations are regulated by the Mediation by-laws (Official Gazette 51/05) passed by the Steering Committee of Croatian Chamber of Trades and Crafts.
The duty of the President, Vice President and Secretary of the Centre is performed by the President, Vice Presidents and Secretary of the Court of Honour of Croatian Chamber of Trades and Crafts.
The Centre for Mediation cooperates with similar institutions at home and abroad, mediation organizations, as well as the Ministry of Justice of the Republic of Croatia.
Secretary of the Centre for Mediation provides information on services, prepares mediation agreements, confidentiality statements and other, acts as a mediator between the parties and conciliators and the President of the Centre in the organization of the mediation process itself, keeps records on the conducted procedures.
Under the new Law on Consumer Protection (Official Gazette 79/07) the Court of Honour has been given jurisdiction over consumer disputes. By February 2008 Croatian Chamber of Trades and Crafts will harmonize its By-Laws with the provisions of the new Law.
